1. Agreement to Terms

By accessing or using any website, application, or service operated by LYV Peptides ("LYV," "we," "us," or "our"), including lyvpeptides.com and the LYV Rx reference platform (collectively, the "Service"), you ("you," "your," or "Customer") agree to be bound by these Terms & Conditions (the "Terms"). If you do not agree, you must not access or use the Service.

These Terms constitute a legally binding agreement between you and LYV Peptides. We reserve the right to modify these Terms at any time. Your continued use after any change constitutes acceptance.

2. Eligibility & Age Verification

You must be at least 18 years of age to use the Service or purchase products. By placing an order, you represent and warrant that you are 18 or older and have the legal capacity to enter into a binding agreement. We reserve the right to request proof of age and to cancel orders if age verification fails.

3. Products & Regulatory Acknowledgment

Our products have not been evaluated or approved by the U.S. Food and Drug Administration (FDA) and are not intended to diagnose, treat, cure, or prevent any disease. By purchasing, you acknowledge this regulatory status and assume full responsibility for your decision to use these products.

By placing an order, you expressly acknowledge and agree that:

  • You are an informed adult making a voluntary purchasing decision
  • You understand that LYV products have not received FDA clearance or approval
  • You assume all risk associated with the purchase, possession, and use of these products
  • You are solely responsible for understanding and complying with all applicable laws in your jurisdiction
  • You have consulted, or will consult, a licensed healthcare provider before use
  • Any information provided on the Service (dosing guides, protocols, educational content) is for informational purposes only and does not constitute medical advice
  • You release LYV Peptides from any and all claims, liabilities, or damages arising from your use of the products

This acknowledgment constitutes a binding assumption of risk. If you do not agree, do not purchase.

4. Account Registration

Certain features may require account creation. You agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Orders, Pricing & Payment

All prices are displayed in U.S. dollars unless stated otherwise. We reserve the right to change prices, modify or discontinue products, and correct pricing errors at any time without notice. If a pricing error affects your order, we will contact you before processing.

Payment is processed securely through Stripe. By submitting an order, you authorize us to charge your selected payment method. Orders are subject to acceptance; we may decline or cancel orders at our discretion (e.g., suspected fraud, product unavailability, pricing errors).

Discount codes, if offered, are subject to specific terms and may be limited in quantity, duration, or applicability. Codes cannot be combined unless explicitly stated.

6. Shipping & Delivery

We ship within the United States. Shipping times are estimates and not guarantees. Risk of loss and title for items pass to you upon delivery to the carrier. We are not responsible for delays caused by carriers, weather, customs, or other circumstances beyond our control.

It is your responsibility to provide a correct and complete shipping address. We are not liable for orders shipped to an incorrect address provided by you.

7. Returns, Refunds & Exchanges

Due to the nature of our products, all sales are final unless the product arrives damaged, defective, or materially different from what was ordered. To request a return:

  • Contact support@lyvpeptides.com within 7 days of delivery
  • Include your order number and photos of the issue
  • Opened or used products are not eligible for return

Approved refunds will be issued to the original payment method within 10 business days. Shipping costs are non-refundable unless the return is due to our error.

8. SMS / Text Messaging Terms

By providing your mobile number and opting in, you consent to receive SMS/text messages from LYV Peptides, including:

  • Order and shipping notifications
  • Reorder reminders and product alerts
  • Promotional offers (with your consent)
  • Replies to your inbound messages

Opt-out: Reply STOP at any time. Help: Reply HELP or email support@lyvpeptides.com. Message frequency varies. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages. We do not share your phone number with third parties for their marketing purposes.

9. Intellectual Property

All content, trademarks, logos, graphics, product images, educational materials, dosing calculators, reference guides, and proprietary tools on the Service are owned by or licensed to LYV Peptides and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content without our prior written consent. Limited personal, non-commercial use (e.g., printing a reference guide for personal research) is permitted.

10. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Resell products purchased from LYV without written authorization
  • Misrepresent your identity, age, or intended use of products
  • Interfere with or disrupt the Service's infrastructure
  • Attempt to gain unauthorized access to any systems or data

  • Post or transmit harmful, defamatory, or infringing content

11. Health & Medical Disclaimer

LYV Peptides is a product access platform — not a healthcare provider, pharmacy, or medical practice. We do not prescribe, diagnose, treat, or administer any substances.

The educational content, dosing references, and protocol guides on the Service are provided for informational purposes only. They do not constitute medical advice and should not be relied upon as a substitute for professional medical judgment. Always consult a qualified, licensed healthcare provider before using any peptide product or making changes to your health routine.

By using the Service or purchasing products, you acknowledge that you are doing so at your own risk and that LYV Peptides bears no responsibility for health outcomes resulting from product use.

12. Product Quality & Third-Party Testing

We source products from USA-based, cGMP-compliant suppliers. All products undergo third-party testing with ≥99% purity verification. Certificates of Analysis (COAs) are available upon request. While we are committed to providing the highest-quality products available, we make no warranties — express or implied — regarding fitness for any particular purpose, and all products are sold "as is."

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LYV PEPTIDES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM:

  • Your use of or inability to use the Service
  • Any products purchased through the Service
  • Unauthorized access to or alteration of your data
  • Any third-party conduct on the Service

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify, defend, and hold harmless LYV Peptides and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

15. Dispute Resolution & Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

17. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and LYV Peptides regarding the Service, superseding any prior agreements.
